Boat tours with dives

1. Applicability
These General Terms and Conditions apply to the services offered by Karin Star Boat Tours, hereinafter referred to as KarinStar.

2. Insurances
The participant is not insured by KarinStar and takes part at his own risk in
boat tours and dives participate. The participant undertakes to independently ensure sufficient insurance coverage

3. Liability
KarinStar is liable in cases of intent or gross negligence in accordance with the statutory provisions. Liability for slight negligence is excluded. Liability for vicarious agents is also excluded. No liability on the part of KarinStar will be accepted if the non-fulfillment or improper fulfillment of the offer is due to:
a) Failure of the participant
b) unforeseeable or unpreventable failures by third parties to comply with the

c) force majeure or to an event that KarinStar could not foresee or avert.
d) Karin Star assumes no liability for loss of personal belongings. Damages are limited to the boat tour amount.

4. Diving ability
The participant undertakes to complete the forms submitted to him truthfully
to fill out and inform KarinStar at any time and immediately of any changes in health that may affect the ability to dive. Prerequisite for participation are good swimming skills. KarinStar reserves the right to exclude participants in case of concerns.

5. Price, terms of payment
The prices are incl. Value added tax. The total amount is to be paid before the start of the boat trip. In the case of a reservation, the amount is due at the time of reservation.

6. Cancellation
In case of cancellation 24 hours before the event, the full purchase price will be refunded. After that it remains 100% owed unless. In case of illness, upon presentation of a doctor’s certificate, 50% of the purchase price will be refunded.

7. Tour cancellations by KarinStar
KarinStar reserves the right to cancel the event in case of insufficient number of participants or other
circumstances (e.g. force majeure etc.) to cancel a tour. KarinStar will carry out the tour as far as possible according to the program, but reserves the right to change the program, services, etc. if this seems necessary due to objective circumstances. If KarinStar cancels the tour or does not offer a replacement program, the participant is entitled to a refund of the full tour cost. Further claims are excluded.

8. Photo and film material
By agreeing to these GTC, the participant grants KarinStar the right to use all film, photo and audio recordings produced either by KarinStar or by participants during the tour for its own purposes without further consultation.

9. Severability clause
Should one or more of the above provisions be invalid or incomplete, this shall not affect the validity of the remaining provisions. The contracting parties undertake to replace the respective invalid provision by a provision which, in terms of its content, comes as close as possible to the original intention.
